Trading conditions

Vendor guarantees for the article in range of Commercial Code No. 513/1991 as amended in later laws.

Term of warranty

Supplied articles except printer cutters, label tongs, accumulators , software, printheads, plastic covers, connectors, cables and bargain articles are guaranteed for term mentioned in Certificate of warranty.

Software, accumulators, cutters, label tongs, plastic covers, connectors and cables are guaranteed for 3 months from the date of sale.

Printheads are guaranteed only under condition they will be used permanently for thermotransfer printing (through colour ribbon) only, for 3 months from the date of sale or 25,400 m of printed media (1,000,000 inches printed). Printer cutters are guaranteed for 6 months.

Cipherlab laser engines are guaranteed for 1 year.

The guarantee term starts by the date of delivery to customer or agreed forwared (§430 Comm. Code). The term is interrupted by taking the article into claim and continues by teh delivery of repaired article. In case the customer will not withdraw repaired article, the term continues from the day te vendor calls customer to withdraw the article. This day is recorded in Record of warranty service.

Certificate of warranty

Certificate of warranty is a part of Delivery note. The guarantee term is mentioned there.

Customer must submit valid Certificate of warranty to demand claim. In other cases the warranty is not granted.

Disposal of sales returns

Customer apllies claim in service site of vendor. To demand warranty customer must submit:

• sale document of the article
• Certificate of warranty
• complete article including original manual cover and accessories
protocols about all service operations if the article was serviced before

Customer covers transport expenses of article claim to service site. Vendor covers transport expenses from service site to customer's address.
In case unauthorized claim all expeses are covered by customer. If customer wants repair in customer's place, customer cover travel expenses of vendor in amount determined in actual pricelist also in case of warranty repair. In case of unauthorized claim cutomer covers travel expenses together with compensation of time spent by travelling and repairing in fuul price determined by actual pricelist.

Vendor is entitled to decide whether claim defect of article is not in exceptions mentiond in part 4 of Warranty conditons. If yes, expenses of repairs are cover by customer. In extraordinary disputable cases the defect vill be sent directly to manufacturer to make decision. Both sides will respect the desicion of the manufacturer as final and crucial.

In case the article is not marked by original label with type description and manufacturing label, vendor is entitled to charge expenses for finding information in database in amount of 300 CZK to customer.

In case of article exchange the term of warranty is not prolonged.

Exceptions from warranty

Warranty cannot be requested for these cases:

• warranty plomb is damaged or removed
• defects are caused by improper manipulation in conflict with manual
• defects caused by mechanical damage (fall, stroke, torn off connectors, blow-out contacts, etc.)
• on claimed article or its installation modifications were made by other person than vendor's service technician
• defects caused by transport, improper placing or stocking in humid, dusty or chemical or other unsuitable place
• defects caused bz exhausted accumulators
• defetcs caused by penetration of foreign substance into article (sand, ashes, water, etc.)
• defect of printer or printhead not using thermotransfer ribbon supllied or approved by vendor
• defetc of printhead in case of thermo printing (this technology does not make warranty possible)
• customer plug the article in electricity other than mentioned in CSN

Reparing, term for withdrawing

Customer is due to withdraw repaired article up to 1 month from repair finish. In case of not withdrawing vendor will send prompt about necessity of withdrawing the article from repair in existing term. After this term vendor is entitled to dispose of article in own way.

Agreement of customer with warranty conditions

By taking article and not applying complaints about its functionality, Delivery note, Certificate of warranty and warranty conditions up to 1 month from the date of taking customer agrees with warranty conditions and declare his knowledge of their content.

Electronic waste code

Application of Code No. 185/2001, about waste and Code No. 7/2005, which results from Europian legislative about waste 2002/96/ES, known as "Electronic waste code", on which base the importer has from 13. 8. 2005 duty to participate on disposal of such devices:

CODEWARE company is a member of collective system REMA (www.remasystem.cz), through which will participate on financing collection and disposal of IT products and AV electronics.

Withdrawal of contributions on electronic waste disposal will be done by form of billing recycling financial additional charge, mentioned on every sale document as separate item. By the interpretation of law this charge is billed by vendor (dealer) further, so the inter-vendor has no expenses. Only end-users pay this extra charge.

Important notice to application of this code - in case that your supplier cannot prove this duty, you as a end- or inter-vendor undertake responsibility for teh manufacturer due to §37j par. 4.
